GENERAL TERMS AND CONDITIONS FOR THE USAGE OF Medico Travels SERVICES

Definitions

Medico Travels: Employees working at Medico Travels Sa'l'k Hizmetleri And/or a company, customer services crew and assistance services crew included but not limited to these, entire crews, personnel and/or employees.

You and/or the User (the Customer): Person and/or corporations who request to benefit from the Treatment (described in the definitions below) provided by Medico Travels and/or Toureshte Services (described in the definitions below) or who request to benefit from services provided by Additional Service Providers (described in the definitions below).

Medical Service Provider: Any medical professional that provides treatment and post-treatment services as well as hospital, clinic, medical Centre, medical doctor, doctor's office, medical procedure etc.

Additional Service Provider: Companies or persons other than Medical Service Provider who take part in your medical travel in Turkey such as hotels, transportation companies, insurance companies, restaurants.

Included but not limited to the mentioned above, all kinds of Medico Travels communication channels within the Medico Travels, which connects Service Providers with you.

All kinds of conversations, dialogues and correspondences using communication instruments (including e-mail, WhatsApp, Skype, Telegram, GSM, phone, Viber but not limited to these) with authorities of Medico Travels.

All kinds of service and type of assistance (verbal, written, visual, physical or based on communication included but not limited to these) including but not limited to customer consultancy, assistance etc. which you may receive from the personnel and employees working at Medico Travels. 

Service Data of Medico Travels: All kind of information, data and presentation verbally or visually made by Medico Travels and/or Medico Travels Services consisting of information provided to Medico Travels by third parties and/or collected from online or offline sources including but not limited to Preliminary information and content for Service Providers and their services and / or for the Treatment Service provided by Medical Service Providers to Users (defined as the definitions below) in Medico Travels and/or in Medico Travels Services.

Treatment: Medical treatment to be performed at the selected Medical Service Provider.

Treatment Package: Package tour options offered by Medico Travels including but not limited to Medical Service Provider, Additional Service Provider and Medico Travels Services which are provided with different Service Provider options and which you can create with your personal preferences.

Revised Treatment Package: The new (revised) Therapy Package to be created by recalculating the variables such as specified periods, treatment methods, prices etc. in accordance with your medical condition in cases where data cannot be foreseen (as indicated in the definitions below) and/or caused a change in Treatment Planning and Treatment Package after physical diagnosis and pre-operative medical examinations performed by your Medical Service Provider.

Data: All requested personal data, private individual and medical data (name, surname, e-mail address, personal information, flight information, nationality, phone number, patient images, medical reports and information including but not limited to height, age and weight) in order for Medico Travels and/or Medico Travels services to analyze your requests and conditions thoroughly and to prepare a special Treatment Package for you.

 

About this User Agreement

From now on, all persons and institutions using the Medico Travels Services in the Definitions section and/or request to use it shall be referred to as "the User". These terms and conditions (hereinafter referred to as the "User Agreement") are signed by and between the User and Medico Travels Sa'l'k Turizm Sanayi ve Ticaret A.'. (herein referred to as "Medico Travels"). This User Agreement grants Toureshte right to use personal, private and medical information (herein referred to as "Medico Travels Service Data") downloaded or displayed on the Medico Travels services and on all services offered within the Medico Travels (herein referred to as Medico Travels Services), including but not limited to this User Agreement, the website offered by Medico Travels, the communication conducted by means of communication tools, social media platforms, Medico Travels assistance and consulting services. You agree to be bound by this User Agreement by accessing or benefiting from Medico Travels Services. Medico Travels reserves the right to amend and/or add to the User Agreement without prior notice. Please read carefully what is written in this User Agreement. Some of the Medico Travels Services are subject to additional terms. Additional terms shall be provided with the respective Medico Travels Services, and these additional terms shall be part of the User Agreement with Medico Travels if you use these Medico Travels Services.

 

1.     Responsibilities of Medico Travels and Scope of Medico Travels Services

1.1     Medico Travels Services is a common market place designed to meet Service Providers and Users. In Medico Travels Services, Service Providers are responsible for the services they offer

1.2     Medico Travels is a health tourism intermediary company. Medico Travels does not operate and/or control any service provided by the Service Providers in the Medico Travels Service Data and/or to the Users. Medico Travels and/or Medico Travels Services do not have medical qualifications and shall not be held responsible and/or take responsibility for any procedures performed by the Medical Service Provider you receive through the Medico Travels sales channels. Medico Travels shall not be liable for any allegations of malpractice (misapplication) which may be directly or indirectly caused by any type of care, treatment, or another service you receive by Medical Service Providers or their advice. Similarly, Medico Travels does not assume any responsibility or liability for any complications and dissatisfaction resulting from the Treatment of the Medical Service Provider. We strongly advise that you carefully read the User Agreement, notice and approval forms of the Medical Service Provider before you begin your treatment as a Medico Travels from our Medical Service Providers.

1.3     Medico Travels does not provide medical service and/or treatment within its body. The medical information contained in the Medico Travels Service Data is based on information provided by Medical Service Providers and/or other third parties. Medico Travels Service Data is for informational purposes and does not constitute a health service. Although Medico Travels Service Data is related to diseases and treatments, this information is for preliminary information only, it should not be used for diagnosis and treatment in any way. Diagnosis and Treatment must be performed by a Medical Service Provider. Please contact your Medical Service Provider for any problems that require treatment.

1.4     Medico Travels Service Data should not be used as the basis for diagnosis, treatment selection or medical service provider. Medico Travels is not considered to be involved in medical practice because it presents the Medico Travels Service Data, and the information contained herein is not intended to support the medical advice of a qualified physician. Medico Travels Services and Medico Travels Service Data are designed solely as a database that enables Users to conduct their investigations and investigations on healthcare services and Medical Service Providers specified herein. The user must not request any representation and/or recommendation from any Medico Travels employee or rely on him to decide on Treatment.

1.5     Medico Travels provides Medico Travels Service Data to its Users via Medico Travels Services, which is provided by Service Providers or collected online and offline from a variety of sources. Although Medico Travels gives sufficient attention to the performance of the services, Medico Travels shall not be responsible for the situations such as misleading and/or misinformation provided by the Service Providers, incomplete data which may be caused by reasons such as not delivering the information, all information provided is not accurate, incomplete or inaccurate (including, but not limited to, express and / or typographic errors). Medico Travels Services or Medico Travels does not guarantee and does not undertake the quality, service level or quality of any Service Provider.

1.6     Medico Travels Services facilitates communication between Service Providers and Users, thanks to marketing channels. Medico Travels offers a variety of forms that the User can use, in particular, to provide information about the medical services of the Medical Service Provider. If the User and the Medical Service Provider have reached an agreement between them for medical treatment, Medico Travels is not included in this medical Treatment agreement between the User and the Medical Service Provider and in no way affects the outcome or content of the agreement. Medico Travels does not accept any responsibility for the implementation and/or non-performance of any right, liability or obligation that is committed and/or is not, and/or is not committed, to the User for any agreement between the Medical Service Provider (or any other third party) and the User.

1.7     The Medico Travels and/or Medico Travels Services offer a Treatment Pack consisting of different Service Provider alternatives after communicating with the Users themselves. The prices of the Service Provider options within this Treatment Package may be different, and the Users have the freedom of choice based on their personal decisions.

1.8     All Treatment Packages have expiration dates. These expiration dates are clearly indicated in your Treatment Packages. You have the right to receive your Treatment Package at the specified price until the end of this expiration date (GMT +03: 00-time zone). After the expiration dates in the Treatment Packs, the Therapy Package prices may vary, and Medico Travels will not be held liable for any price changes that may occur due to your late booking.

1.9     Your Treatment Package may only be estimated according to your data. Therefore, during and after the physical examination with your Medical Service Provider, the price of your treatment, the duration of your stay and the like may vary.

1.10     Your Treatment Package covers all pre-operative tests. However, you may be charged additionally for any pre-existing condition or for any additional conditions or for any additional tests required due to your predisposition.

1.11     In your treatment package, you will be given the time you need to stay in the hospital due to your treatment. If you need to stay in the hospital for more nights than indicated in your Treatment Package, the additional nights will be charged to you at the hospital's current price policy.

1.12     You must pay an advance payment of up to 10% of the total amount of Therapy Package to Medico Travels, after making your selections from the alternatives in the Treatment Pack presented to you from the Medico Travels and/or Medico Travels Services (1 Medical Service Provider including but not limited to recommended for 1 Medical Service Provider). You also need to complete the payment of the remaining amount before you start your Treatment in your Medical Service Provider. You will not receive any Medical Treatment before completing your payment.

1.13     The User has the right to make payment to Medico Travels before the commencement of his/her treatment after 10% advance payment is deducted from the total amount of the Treatment Package by means of the payment options (through the payment systems of Medico Travels Services, 3rd Party Partners or Service Providers) including in cash, by credit card, bank transfer. If the User chooses one of the payment methods other than cash payment (cash) in these payment methods, the User shall be responsible for the payment of all costs incurred, including but not limited to any commission, cost, inter-bank transfer fees, which may occur in this type of payment. The User is obliged to pay Medico Travels the specified net fee of the Treatment Package he / she has approved by accepting this User Agreement.

1.14     If your Therapy Package changes as a result of a physical examination by your Medical Service Provider or because of your test results, you are entitled to discontinue treatment. In such a case, you will receive a refund after deducting the total costs you paid and the costs involved in the tests and consultations carried out so far. Please note that Medico Travels is not responsible for refunding your stay, travel and transfer charges since these operations are performed by Additional Service Providers and are not controlled by Medico Travels and/or not operated by Medico Travels. You shall be notified by the Medico Travels and/or Medico Travels Services of the Revised Treatment Plan after any change in your plan. If the Treatment Package changes, your stay duration may also vary. Medico Travels does not take responsibility for this and cannot be held responsible for the remaining days of organising the remaining days or for the extra cost of the additional stay duration.

1.15     If you have less than 1 month to your treatment and you wish to cancel your treatment, the 10% advance payment you have paid to Medico Travels will not be refunded, provided that the provisions of Article 2.7 of the User Agreement are excluded. If you want to cancel your treatment more than 1 month before your advance payment will not be refunded, but within 6 months you have the right to be treated again at any time and in the Revised Treatment Package to be created, your advance payment will be calculated by deducting the total amount of Treatment. You have only one (1) time to postpone your treatment.

 

2.    Responsibilities and Rights of the User

2.1     You agree to share any data related to your medical condition by agreeing with this Agreement.

2.2     The User is obliged to provide the Data with Medico Travels to facilitate Medico Travels Services and to get better service by Medico Travels and/or Service Providers. The User must accept the Medico Travels User Agreement and Medico Travels's Confidentiality Agreement in order to benefit from the Medico Travels Services.

2.3     Responsibilities for passport, Visa and transportation (air, land, sea, etc.) shall be borne by the User. Medico Travels is not responsible for any inconveniences arisen from these situations. Medico Travels's responsibility starts from the moment when you come to Turkey and meet with officials of Medico Travels.

2.4     By confirming this User Agreement, you agree that your Data will be received by your Medical Service Provider from Medico Travels and will be kept in records if deemed necessary.

2.5     Users who come to Turkey within the health tourism scope must take out travel insurance. Therefore, you agree to take out travel insurance when you use Medico Travels Services.

2.6     The User may at any time request that his/her data should be hidden in Medico Travels databases by sending an e-mail to info@medicotravels.com. In this case, User Data is hidden by Medico Travels and cannot be used for any promotional or advertising purposes.

2.7     The User has the right to withdraw from the Agreement without giving any justification and without paying any penalty within fourteen days (14) after making 10% advance payment. It is enough that the notification of the right of withdrawal is delivered to the Seller or the Provider within this period. In respect of the rights and obligations of the User, the provisions of the Law on Consumer Protection shall be taken as the basis for revocation.

 

3.     Medical Examination

Medico Travels reminds you that every kind of treatment carries some medical risks, especially the risks associated with aesthetics and plastic surgery as well as dissatisfaction with the results. You and your selected Medical Service Provider should agree with each other about the expected outcome of the treatment. Therefore your expectations from the results may be more realistic. It is your responsibility to make the final decisions for treatment by discussing with your medical doctor at your Medical Service Provider face to face before the treatment.

 

4.     Post-Treatment Period

You shall be notified by your Medical Service Provider about the period after the end of the Medical Treatment. You have to apply these notifications. Your Medical Service Provider and/or Medico Travels may not be held responsible for any problems which may arise if you fail to comply with these notices. In case of issues which may occur after you have returned to your country, we shall assist you by delivering the results of a medical doctor's examination in your home country and if necessary, your photos to Medico Travels by sending these results to your Medical Service Provider and sharing the answers we have received. The costs of the examination and treatment services performed abroad shall be borne by you. Medico Travels and/or your Medical Service Provider are not responsible for these fees.

After the end of the treatment, there is no possibility for your Medical Service Provider or Medico Travels to make any refunds for you.

 

5.     Feedbacks and Comments

Medico Travels aims to provide excellent service. Medico Travels require feedbacks from its Users to improve Medico Travels and Medico Travels Services, provided that the assessments are sincere, honest and directly related to Medico Travels Services.

Medico Travels is a tool to provide good quality Treatments at affordable prices. However, Medico Travels may not be held responsible for the services provided by the Medical Service Providers and the Additional Service Providers described in the Definitions section at the beginning part of this User Agreement.

In case of dissatisfaction with the services of the Service Providers, a review against Medico Travels (including but not limited to comment sites, social media networks, blogs, and public forums) is subject to criminal requirements. If this clause is not followed, you agree to pay ' 10,000 in damage to the Medico Travels if part or all of the content of the article remains. Istanbul Courthouses and Enforcement Offices are authorised for any disputes that may arise in this regard.

 

6.     Privacy and Data Protection

Medico Travels is the absolute responsible for the protection of your data. Medico Travels shall not disclose your data without your consent and shall only share with Service Providers. 

To ensure your privacy, Medico Travels shall maintain all User information related to the disclosure and reveal of your Data in accordance with relevant Turkish Laws. You can review our Privacy Policy for more information. Your data shall not be sold or rented to the third parties. You also grant permit Medico Travels to use your previous and subsequent images anonymously to improve the Medico Travels Services and provide a better User service by accepting this User Agreement.

 

7.     Amendments to this User Agreement

The User Agreement signed by and between Medico Travels and the User is valid as of the date of the signed by the User. It is the sole responsibility of Medico Travels to notify the User about any amendments made to this User Agreement by e-mail and/or by a telephone number which are provided by the User to Medico Travels. If Medico Travels doesn't make the notification about the amendments, this User Agreement shall be valid as of the date on which it was approved by the User.

The e-mail address and/or telephone number included in the Data provided to Medico Travels by the User to benefit from the Medico Travels Services shall be deemed as to be the official communication and notification address.

We may update our User Agreement from time to time. We shall notify you about any amendments by including our new User Agreement on this page.

As Medico Travels, we recommend that you should review our User Agreement for any amendments to this Agreement periodically. Amendments to this User Agreement shall be applied when they are issued on this page.

 

8.     Resolution of Disputes

Medico Travels and the User shall first endeavour to settle all disputes arising from this User Agreement by resolving with each other.

Istanbul Courts and Enforcement Offices shall be authorised for the disputes that will arise in this User Agreement

 

9.     The Language of the User Agreement

This User Agreement was issued in two (2) languages as in English and Turkish, and in the event of any disputes, Medico Travels and the User has agreed that Turkish version of the Agreement shall be valid.
